1. This Notice is issued by CITAGLOBAL CAPITAL SDN. BHD. (Company No. 200701025683 (783704-V)) (“we”, “our”, “us” or “CCSB”) as a data user pursuant to the Personal Data Protection Act 2010 (“PDPA”), and it shall apply to you as a data subject.
2. The definition of the terms “personal data, “data subject,” “data user” and “data processor” shall be similar to that as defined in the PDPA 2010.
3. You hereby consent that we may collect, record, store, use and/or process your personal data. Such consent shall remain in force until revoked in writing by you.
4. Personal data includes but not limited to name, address, copies and details of identification documents, details of bank account, employment history, credit and references check, marital status, commission or alleged commission of offence, personal financial details
5. You hereby consent that we may also collect, record, store, use and/or otherwise process your information from other sources and you hereby authorize us to process any of your information which we may require from any sources. Without prejudice to the generality of the foregoing, we may collect or otherwise process your information from any third-party background checks, any credit reporting agency, or any regulatory bodies, government agencies, and any authority (such as BRIM), for the following purposes:
i. To check on your credit worthiness or perform a check on any outstanding litigation.
ii. To obtain and verify any information relating to your credit intelligence, profile and other credit information;
iii. To obtain and verify any information about you as we in our sole discretion shall deem fit, including for the purpose of complying with anti-money laundering laws; and
iv. To disclose any information and data relating to you to Bank Negara Malaysia, any governmental or regulatory agency or authority, any credit bureau, any credit reporting agency, and any other individual to whom disclosure is permitted and/or required by law.
6. You hereby acknowledge, confirm and consent that we may collect, record, store, use and/or otherwise process your personal data for the following purposes:
i. in all matters pertaining to the loan agreement entered into between you and us;
ii. to process your application, request and/or queries;
iii. for the provision of services
iv. for the purposes of internal management of the services provided and risk management;
v. monitoring compliance with the agreement in paragraph (a) and our rules and policies for the time being in force, and any other applicable laws;
vi. complying with the compliance and disclosure requirements of all governmental and/or quasi government departments, agencies, regulatory and/or statutory bodies;
vii. complying with any legal obligation imposed on us by any law, rule, regulation, by-law, order, guideline, directive, policy and such other requirements in force and as amended from time to time;
viii. enforcing our rights under the agreement in paragraph (a) and our rules and policies for the time being in force.
ix. for record-keeping purposes in the ordinary course of our business;
x. for the purposes of circulating, transmitting and/or delivering to you, by any means (including emails, short messaging services, regular mails and other means), promotional and commercial materials (including services, advertisements, marketing) relating to our services; and
7. Your personal data in our possession will be kept confidential and we may provide such information to the following parties (“Third Party”) for the purposes set out in paragraph 9 above:
i. any person to whom we are under an obligation to make disclosure under law, rule, regulation, by-law, order, guideline, directive, Notice;
ii. our auditors, accountants and tax advisers;
iii. our legal advisers and compliance professionals;
iv. our banks
v. our professional advisers, service providers and vendors.
8. For general web browsing although no personal data is revealed to us, certain technical and statistical information is available to us as cookies, your IP address, the time, date and duration of your visit. If you provide us with any personal data relating to a third party, you represent to us that you have obtained the necessary consent to provide us with their personal data.
9. You may request access to your personal data, or make any enquiries or complaints in respect of your personal data, by contacting us at cgcapital@citaglobal.my.
10. You are to esnure that the personal data that you provide to us is accurate, complete and not misleading and that such personal data is kept up-to-date, and you shall promptly keep us informed in the event the personal data is inaccurate, incomplete, misleading or not up-to-date and to then provide us the true, accurate, complete, and updated personal data.
11. We will retain your data for as long as is required for us to comply with our obligations imposed under any law, regulation or accounting requirement. We will permanently erase your personal data if your personal data is no longer necessary for the fulfilment of the purposes set out in this Notice.
